TERMS AND CONDITIONS
CUSTOMS CLEARANCE SERVICE

The present terms and conditions govern the customs clearance of your package, prior to delivery of the packageto you (the “Client”) by Rennel Limited (“Rennel”), Licensee of Federal Express Coporation / TNT associate in
Mauritius.

1. Electing the Service:

1.1. Rennel will notify the Client when his imported package is required to be customs cleared prior to delivery to him of the said package by Rennel. The Client may elect the service of Rennel for customs clearance of his package, subject to the present terms and conditions (the “Service”). Additional charges/fees may apply if the package is not customs cleared within forty-eight (48) hours of the said notification.

1.2. If the Client chooses NOT to elect the Service and choose another provider, the Client shall:

  • Pay to Rennel immediately (prior to delivery), an administrative fee for handling the Client’s file amounting to Rs 1500.75.
  •  provide promptly to Rennel by email, addressed to deliveryallowed@rennel.mu a confirmation of successful clearance issued by the customs authority in Mauritius, before Rennel can proceed with delivery to the Client of his package.

1.3. If the Client does not reply to Rennel with regards to electing the Service, Rennel will consider that the Client does NOT wish to elect its Service, unless the Client:

  • informs Rennel in another way that it does wish to elect its Service;
  •  pays Rennel’s customs clearance charges within 48 hours of notification of charges by Rennel; or
  •  replies to Rennel’s SMS with his/her NIC number,

in which case, Rennel will consider that the Client has elected the Service subject to the terms and conditions herein.

1.4. Despite the aforesaid, the Client must provide to Rennel his National ID Card No or BRN to proceed with the Service.

2. The Service


If the Client elects the Service of Rennel for customs clearance of his package, the Service will be subject to the following:

2.1. Payment:

  1. Payment of all clearance charges, administrative fees and duties is due and payable by the Client to Rennel upon delivery*, failing which storage costs will apply and be immediately payable by the Client. IMPORTANT: Rennel reserves the right to delay delivery until full payment is settled.

    *If the total of Duties and VAT exceeds Rs.5,000.00 [five thousand Mauritian Rupees], payment must be effected immediately by the Client prior to Rennel’s scheduled customs clearance by Cash (where authorised), Cheque, Juice by MCB or bank transfer.

  2. For files referred by the customs authority in Mauritius to regulatory bodies for clearance, an additional administrative charge of Rs.300.00 plus Value Added Tax shall be immediately payable by the Client to Rennel before delivery, without prejudice to any other statutory charges.

2.2. Delivery:

  1. Rennel does its best to deliver on time. However, delivery dates are estimates only. If the Client is unavailable to take delivery at the delivery address, the Client will be notified to collect his parcel at Rennel’s office. Storage costs may apply after unsuccessful delivery and be immediately payable by the Client.
  2.  Rennel reserves the right to return the shipment to the sender/destroy the shipment should a shipment’s clearance not be initiated within five (5) days of the arrival of the package being notified to the Client.
  3. The customs authority in Mauritius may dispose of the Client’s package, as it deems fit, if it is not cleared from customs or claimed within two (2) months of landing date.

2.3. Liability and Suspension or Termination of Service:

  1. The Service applies to the clearance of the Client’s package only. Rennel’s liability herein, if any, is strictly limited to its customs clearance fee (excluding storage costs) claimed from and payable by the Client.
  2.  As per law, it is the sole responsibility of the Client to provide in a timely manner, true and accurate information regarding his personal details, the package content and value. The Client hereby warrants that all information provided by him or on his behalf to Rennel and/or the authorities is true and accurate.
  3. The Client shall defend Rennel and its affiliates and their respective officers against any claim(s) and/or prosecution(s) arising out of or in connection with any non-compliance by the Client of these terms and conditions and/or any legal provision and shall indemnify Rennel for any expenses, fines and penalties whatsoever that it incurs as a result of such claim(s) and/or prosecution(s).
  4.  Non-compliance by the Client with any of these terms and conditions, entitles Rennel to terminate the Service and/or immediately claim from the Client, expenses, costs and charges incurred by Rennel so far in the Service, together with interest at the legal rate, attorney’s commission, costs and applicable taxes thereon.

3. Governing Law and Jurisdiction

  1. The present terms and conditions are governed by the laws in force in the Republic of Mauritius. Any dispute arising from these Terms and Conditions shall be referred to the competent jurisdiction of the courts of Mauritius.

4. Miscellaneous

  1. Except as may be expressly provided for in these Terms and Conditions, a waiver by Rennel, or a failure by Rennel to claim a default of the Client, of any provision of these Terms and Conditions shall not constitute a waiver of any default or subsequent default.
  2.  If any these Terms and Conditions is held to be invalid and/or unenforceable by a court of competent jurisdiction, then these Terms and Conditions, including all its remaining terms, will remain in force and effect as if such invalid or unenforceable term had never been included.
  3. No rule of construction shall be applied to the disadvantage of Rennel regarding these Terms and Conditions.
  4. Headings used in these Terms and Conditions are provided for convenience only and shall not be used to construe meaning or intent. Words importing one gender shall include the other and words importing the singular shall include the plural and vice versa.
  5. .Any reference to a person includes, without being limited to, any individual, body corporate, unincorporated association or other entity recognised under any law as having a separate legal existence or personality
